These Terms of Service (“Terms”) govern your use of the ESGSutra website (esgsutra.com) and the tools provided through it. By using our services, you agree to these Terms.

1. Services

ESGSutra provides free ESG compliance tools for Indian companies, including:

  • BRSR Gap Analyser — assesses BRSR reporting maturity using the SRMM framework.
  • Carbon Footprint Calculator — calculates greenhouse gas emissions using IPCC emission factors.
  • Regulation Summariser — generates plain-language summaries of ESG regulations using AI.

These tools are provided free of charge during our beta period. We reserve the right to introduce paid tiers or modify pricing in the future, with advance notice.

2. Account and Access

  • No account creation is required. Tools are accessed by providing your business email address.
  • You must provide accurate contact and company information.
  • You are responsible for the accuracy of data you input into our tools.

3. Acceptable Use

You agree not to:

  • Use our tools for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or automate access to our tools beyond normal use.
  • Submit false or misleading information.
  • Attempt to gain unauthorised access to our systems or other users’ data.
  • Use our tools to generate content that misrepresents regulatory requirements.

4. AI-Generated Content

Certain tools use Anthropic’s Claude AI to generate analysis and summaries. Regarding AI-generated content:

  • AI outputs are provided for informational purposes only.
  • AI-generated analysis should not be used as the sole basis for regulatory filings, compliance decisions, or legal actions.
  • AI outputs may contain errors, omissions, or inaccuracies. Always verify AI-generated content with qualified professionals.
  • ESGSutra does not guarantee the accuracy, completeness, or regulatory compliance of AI-generated content.

5. Tool Output Disclaimers

BRSR Gap Analyser

The SRMM scoring and gap analysis are based on the ICAI Sustainability Reporting Maturity Model framework. Results are indicative and should be validated by a qualified sustainability consultant or assurance provider before use in BRSR filings.

Carbon Footprint Calculator

Emission calculations use standard IPCC emission factors and the GHG Protocol Corporate Standard methodology. For BRSR filing and assurance purposes, verify emission factors with your assurance provider. Actual emissions may vary based on fuel quality, equipment efficiency, and measurement methodology.

Regulation Summariser

Regulation summaries are AI-generated interpretations of regulatory text. They do not constitute legal advice. Always refer to the original regulation text and consult qualified legal professionals for compliance decisions.

6. Intellectual Property

  • Our content: the ESGSutra website, tools, branding, and original content are our intellectual property.
  • Your data: you retain ownership of the data you input into our tools.
  • Tool outputs: results generated by our tools may be used freely by you for internal business purposes.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ESGSutra provides services “as is” without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of our tools.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us (which, during the free beta, is zero).
  • We are not responsible for decisions made based on tool outputs, including regulatory filings, investment decisions, or compliance actions.

8. Data Processing

By using our tools, you consent to the processing of your data as described in our Privacy Policy. This includes the use of AI services for tools that require it.

9. Service Availability

  • We aim to maintain high availability but do not guarantee uninterrupted access.
  • We may modify, suspend, or discontinue any tool or feature at any time.
  • We will provide reasonable notice before discontinuing any core service.

10. Rate Limiting

To ensure fair usage, tool endpoints are rate-limited to 10 requests per IP address per hour. Excessive use may result in temporary access restrictions.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our services after changes constitutes acceptance of the updated Terms.
